# Drunk Driving Challan India — ₹10,000 Fine & Licence Suspension
Drunk driving (driving under the influence, DUI) is the most serious traffic offence in India short of an accident. Penalties under the MV Act 2019 are severe.
Legal Blood Alcohol Concentration (BAC) Limit
- 30 mg per 100 ml of blood for private vehicle drivers
- 0 mg (zero tolerance) for commercial vehicle drivers (bus, truck, auto, taxi, cab)
Penalties
What Happens After You Are Caught
1. Breathalyser test at the spot
2. If positive, you are taken to the police station
3. Blood test if you refuse the breathalyser
4. Vehicle impounded
5. Challan filed in court (this is a court challan, not just an echallan)
6. Driving licence sent for suspension to the licensing authority
Court Challans vs E-Challans
Drunk driving challans are court challans — they do not appear on the Parivahan echallan portal. You must appear in court (or send a lawyer) and pay the fine as directed by the magistrate.
Check Challan Status
For court challans, check with your local traffic police station or the court where the FIR was filed.
Summary
Zero tolerance for commercial drivers. For private drivers, 30 mg BAC is the limit. The fine is the least of your worries — imprisonment and licence suspension are the real consequences.
